| Лицензия | End User Licence Agreement [EULA] Coppers & Brasses Typefoundry version: 1.0 issued in may 2012 Please take some time to read the following End User Licence Agreement. We gave our best to make it as simple and concise as possible. You have to make sure you understand and agree to everything stated below before you actually acquire the licence(s). 1) DEFINITIONS - In this Agreement, ÒFontÓ, ÒFontsÓ or ÒFont SoftwareÓ have identical meanings and are defined as the designs of the Fonts and the software that produces a typeface design(s) together with any other artworks that may be associated with the Font. - ÒYouÓ, ÒYourÓ and the ÒEnd UserÓ are defined as and refer to a customer who has purchased a license to use the Font. An End User is not defined as a distributor, reseller, dealer, sub-licensee, original equipment manufacturer (ÒOEMÓ), or other wholesale buyer, etc. Coppers & Brasses products may not be distributed and/or sold to third parties without prior written consent from Coppers & Brasses themselves. - ÒOutput DeviceÓ is defined as any device producing a usable representation of the Font, such as, but not limited to: a printer, image setter, laser setter, plate maker. 2)PERMITTED USES AND RESTRICTIONS - INSTALLATION: The Font may be installed and used on the number of workstation computers identified in your sales receipt. For example, the purchase of a single license allows for the installation and use of the Font on one (1) computer. Please refer to your sales receipt for the amount of installations permitted. The Font Software may be installed and used on a laptop as a secondary and alternate use computer. This term is not intended to permit the installation and concurrent use of the Font Software on two (2) computers or workstations, except where such use is expressly licensed. - LOCATION: The Font Software may be installed and used at a single geographic location. If you need a license that permits installation of the Font Software at multiple locations, please contact Coppers & Brasses. - BACK-UP COPIES: You may make a copy of the Font Software for back-up purposes only. Any copies must contain the same documentation, copyright, trademark, and other proprietary notices that appear on, in or with the Fonts. As a best practice, a copy of the sales receipt should always be included with the Fonts. - ALLOWED USES: You may use the licensed fonts to create images on any surface such as computer screens, paper, photographs, movie credits, printed material, T-shirts, and other surfaces where the image is a fixed size. You may use the licensed fonts to create EPS files or other scalable drawings provided that such files are only used by the household or company licensing the font. - MODIFICATIONS: You may create outline artworks based upon the Font Software for your personal or business use. However, the use of any font creation or font manipulation program or any attempt to modify the Font for the purposes of creating a usable or substitute version of the Font is prohibited. Under no circumstances may you modify, adapt, translate, reverse engineer, decompile, disassemble, alter, or otherwise attempt to discover the source code of the Font Software. Any modifications made to the vector outlines shall be considered derivative works and their use governed by the terms and conditions of this Agreement. You further agree not to commission or authorize any third party to undertake modifications to the Fonts without prior written consent from Coppers & Brasses. - EMBEDDING: You may embed the licensed fonts into any document you send to third parties. Such documents may be viewed and printed (but not edited) by the recipients. You may not under any circumstances embed the licensed fonts into software or hardware products in which the fonts will be used by the purchasers of such products. Such use requires a different license which may be offered by the Foundry. Embedding permissions in mobile apps, video games etc depends on a number of factors and may require a different license. Please contact info@coppersandbrasses.com for further information. - WEB USE: You are allowed to use the font on the web as an image only (non-selectable text). It is prohibited to host a copy of the font as a web font on your own website. Converting the font as a .woff file for use on the web is also prohibited. - THIRD PARTIES: You may provide the font to a graphic designer, printer or other service bureau that is working on your behalf only if they agree to use the font exclusively for your work, agree to the terms of this license, and retain no copies of the font on completion of the work. You may not provide the font or make it accessible to any other third parties. - RESTRICTION AS GOODS FOR SALE: This License expressly prohibits the use of the Font Software in the creation of alphabet products, such as, but not limited to: house numbers, stamp sets, rub-on letters, adhesive alphabet letters, alphabet punch and die sets or other methods for use in making such products. Any such use requires the purchase of a special license. Contact info@coppersandbrasses.com for further information. 3) COPYRIGHT - You expressly acknowledge that the Font Software, the designs embodied therein, the trade names and/or trademarks and copyrights associated therewith are each the exclusive property of Coppers & Brasses. - You agree that the Fonts, and all copies thereof, are owned by Coppers & Brasses and the FontÕs structure, organization and code are the valuable trade secrets of Coppers & Brasses. - Unauthorized copying of the Product even if modified, merged, or included with other software, or of the written materials, is expressly forbidden. You may be held legally responsible for any infringement of the foundryÕs intellectual property rights that is caused or encouraged by your failure to abide by the terms of this Agreement. 4) SUPPORT AND UPDATES: Coppers & Brasses may, from time to time, update the Product. Even though we try to provide free upgrades to previous product owners, product upgrade pricing may apply. 5) DISCLAIMER AND LIMITED WARRANTIES: Coppers & Brasses warrants the Fonts to be free from defects in materials and workmanship under normal use for a period of fifteen (15) days from the date of delivery as shown on your receipt. Coppers & BrassesÕ entire liability and your exclusive remedy as to a defective fonts shall be, at Coppers & BrassesÕ option, either return of purchase price or replacement of any such fonts that is returned to Coppers & Brasses with a copy of the invoice. Coppers & Brasses shall have no responsibility to replace the fonts or refund the purchase price if failure results from accident, abuse or misapplication, or if any fonts are lost or damaged due to theft, fire, or negligence. Any replacement software will be warranted for fifteen (15) days. EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE FONTS, IS PROVIDED ÒAS ISÓ. COPPERS & BRASSES DOES NOT MAKE ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The entire risk as to the quality and performance of the Fonts rests upon you. Coppers & Brasses does not warrant that the functions contained in the Fonts will meet your requirements or that the operation of the software will be uninterrupted or error free. COPPERS & BRASSES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE FONTS EVEN IF COPPERS & BRASSES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 6) AGREEMENT: You expressly agree that this Agreement shall be governed by the laws of Canada and the Province of Qubec as they apply to contracts wholly performed therein and without respect to its conflict of laws provisions or the conflict of laws provisions of any other jurisdiction. You expressly submit to the jurisdiction of the province and federal courts in the forum selected by Coppers & Brasses for the purposes of resolving any dispute arising under this Agreement. You hereby expressly agree that the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. This Agreement may only be modified in writing, signed by an authorized officer of Coppers & Brasses. 7) TERMINATION: This Agreement is effective until terminated. This Agreement will terminate automatically without notice from Coppers & Brasses if you fail to comply with any provision contained herein. Upon termination, you must destroy the written materials, the fonts, and all copies of them, in part and in whole, including modified copies, if any. 8) GOVERNING LAW: This agreement is governed by the laws of Canada and the Province of Qubec. 9) AMENDMENTS: Coppers & Brasses expressly reserves the right to amend or modify subsequent versions of this License Agreement at any time and without prior notification. 10) CONTACT If you have any questions concerning this Agreement, or if you desire to contact Coppers & Brasses for any reason, please contact us at: info@coppersandbrasses.com 11) THANK YOU Thanks for purchasing font licences.
